To confirm your trip with Tributrek, a non-refundable down payment of 35% is required to secure services. The remaining 65% is due 70 days before your trip. For trips within 70 days, full payment is required at booking.

CHANGES TO TRAVEL ARRANGEMENTS

If you need to make changes to your booked travel arrangements, an administration fee of USD $50 will apply, along with any additional costs from third-party providers. Tributrek will provide all the necessary support to facilitate these changes. Please note that all reservation changes are subject to availability and the terms and conditions of the booked services.

CANCELLATIONS

Cancellation of the trip, stay or tour by the client.
The cancellation of the trip, stay or tour in Ecuador must be made in writing and will be effective upon receipt of the letter from Tributreek Cia. Ltda.
Cancellations made more than 120 days prior to the start of the services will have a penalty of 10% of the total invoice for administrative expenses and money transfer charges.
Cancellations made between 70 and 130 days prior to the commencement of services will be charged 35% of the total invoice for administrative expenses.
Cancellations made less than 70 days prior to the date of the services will have a penalty of 100% of the total value per person, the total amount of the trip will be charged without the right to reimbursement.
In case the Tour Operator Tributreek Cia. Ltda has to modify the itinerary of the stay, tour or trip in Ecuador due to force majeure such as pandemics, war, strike, demonstration, terrorism, fire, natural disaster, etc. the Tour Operator Tributreek Cia. Ltda, will have no obligation to indemnify the client.

EXCEPTION

In case the tour operator Tributreek Cia. Ltda, has to modify the itinerary of the excursion, stay or trip in Ecuador for operational reasons such as problems with the vehicle, logistical problems, etc, the responsibility falls on the tour operator that provides the service, ie the company that physically operates the stay, activity, transfers (cruise operator in Galapagos, : (Galapagos diving cruises, Galapagos group cruises, Galapagos cruise charters, high demand Galapagos cruise departures and some specific Galapagos cruises, tour transportation company, airlines etc. ). In this case, cancellation fees for these services will be assessed according to the policy of each service provider.

REFUNDS

Refunds will only be paid to you once we have received the funds back from the Third Party Provider(s). We are not responsible for non-payment of a refund by a Third Party Provider. Bank charges and taxes, including the Outgoing Foreign Exchange Tax (ISD), will be deducted from the amount to be refunded. Travel services are non-refundable if the passenger does not arrive on the date and time specified for the services booked.

TERMS AND CONDITIONS

The general conditions of sale are applicable to all types of trips proposed by the tour Operator Tributreek cia ltda including organized tours, transports or any other service (plane tickets, hotels, diving, guides, etc.…) carried out in Ecuadorian territory.
Article 1 – The participants in the stay.
The following articles come into force between the following two parties:
– Tribu Trek Travel (legally registered as the tour Operator Tributreek cia ltda is a tour operator based in Quito, Ecuador, legally constituted and by this fact, subject to all laws and regulations in force in this country regarding the tourism sector.which offers tours, stays, adventure, climbing, trekking, cultural or luxury trips in the Andes, the Amazon jungle, the Pacific coast and the Galapagos archipelago – Ecuador.
– The client who wishes to purchase a package for a trip/stay/tour in Ecuador or the Galapagos from The Operator Tributreek Cia. Ltda (Tribu Trek Travel).
Article 2 – Object of the vacation contract.
The client contracts with the tour Operator Tributreek cia ltda (Tribu Trek Travel), the purchase of a tourist service in Ecuador (Amazon, Andes, Pacific coast and Galapagos archipelago) for a tourism, stay or trekking, adventure, cultural or luxury trip that meets the safety and quality standards imposed by Ecuadorian legislation.
All reservations, confirmations and cancellations must be made in writing via e-mail or fax.
Article 3 – Duration of the contract.
– The contract comes into force at the time of acceptance of the offer between the tour Operator Tributreek cia ltda (Tribu Trek Travel) and its client and lasts until the last day of the contracted tour, stay or trip.
The reservation of a trip to Ecuador will be confirmed at the moment of the reception of the value of the payment.
In order to confirm the reservation of a trip or any of our services in Ecuador, the tour Operator Tributreek cia ltda must receive the information sheets of each participant completed in its entirety and signed by the client.
In the same way, the present document (General Conditions of Sale) will also have to be signed and returned to the tour Operator Tributreek cia ltda in order to validate the registration. The signatory assumes responsibility for all persons listed in the same document.
The organization contract starts at the moment when the client receives the written confirmation of the receipt of the payment from the tour Operator Tributreek cia ltda
The receipt of the payment only implies the reservation only when there is availability.
The invoice will be sent to the client within 5 days after the registration.
Article 4: Price of services.
The agreed price is fixed in U.S. dollars (USD) and includes all services mentioned in the travel information document, subject to obvious material errors.
The price of the trip is calculated per person based on double occupancy. In no way do the prices published or communicated to the client cover the supplement for a single room.
If a single passenger decides to rent the exclusivity of a room for himself/herself, a supplement will be charged, depending on the services.
The possible increase in domestic airfares must be borne by the customer. In no case the tour Operator Tributreek cia ltda will not be responsible for this increase.
Article 5 – Obligations of the parties.
Tour Operator Tributreek cia ltda:
The incoming travel agency the tour Operator Tributreek cia ltda shall be legally registered in the Ecuadorian commercial registry and, consequently, shall be authorized to exercise this activity in Ecuadorian territory.
Tour Operator Tributreek cia ltda, must provide the client with all the necessary information for the correct development of the stay / trip / tour in Ecuador, the Andes, the Amazon, the Coast or Galapagos.
Tour Operator Tributreek cia ltda and its agents or representatives act as organizers. As such, they work with different service providers, different transportation companies, accommodations and other intermediaries required for the organization of stays, trips or cruises. Therefore, the tour Operator Tributreek cia ltda acts as an intermediary between the client and the service providers (transport services, hotels, ship owners…) and should not be confused with the latter who have their own responsibilities. the Operator Tributreek Cia. Ltda is not responsible for the acts of these suppliers, except for errors directly related to direct employees of the Operator Tributreek Cia. Ltda.
Tour Operator Tributreek cia ltda is responsible for the proper performance of the contract in accordance with the reasonable expectations that the client may have on the basis of the travel arrangement contract. In case of omission on the part of any of the service providers, of some of the described obligations, the tour Operator Tributreek cia ltda undertakes to help the traveler to defend his rights in front of the suppliers concerned.
Tour Operator Tributreek cia ltda is committed, during the execution of the contract, to help the client who is in difficulties. In this case, the tour Operator Tributreek cia ltda can apply additional costs to the client.
– In the case of the sale of a service to a particular customer, the tour Operator Tributreek cia ltda, is responsible and obliged to inform the family, the insurance company and the embassy of the client in case of accident. the Operator Tributreek Cia. Ltda is not responsible for injuries or death caused by the client while intoxicated, in an altercation situation or any other circumstance caused by the client’s fault.
– In the case of the sale of a service, trip, stay or tour to a professional clientele (travel agency, tour operators) in Ecuador, the Andes, the Galapagos, the coast or the Amazon, the tour Operator Tributreek cia ltda is responsible for notifying the professional intermediary in case of accident of one of its clients entrusted to the agency, in Ecuador.
The client:
– The client must understand and legally accept the risks involved in the practice of extreme sports such as glacier climbing and trekking in the Andes, rafting, canyoning, snorkeling and scuba diving in the Galapagos and/or the Pacific coast, and any other activity in direct contact with nature, in Ecuador.
The Client shall provide the tour Operator Tributreek cia ltda all relevant information that will be specifically requested.
In addition, each participant must be aware that there are risks of any kind due to local conditions (remoteness of medical centers, lack of means of communication, etc.). He/she assumes them knowingly on his/her behalf and on behalf of his/her beneficiaries and agrees not to hold the tour Operator Tributreek cia ltda.
National Parks, like all other Ecuadorian protected areas (public or private), are governed by strict rules. Compliance with these rules, a good attitude and a certain sense of coexistence are essential qualities to be able to make the kind of trips we offer. The organizer, guide or tour leader reserves the right to exclude at any time from a group a person whose behavior is considered to endanger the safety of the group and the well-being of the participants or the places visited. In this case, no compensation will be paid.
The Client shall provide the tour Operator Tributreek cia ltda all relevant information that will be specifically requested.
If the Client provides incorrect information and this results in additional costs to the tour Operator Tributreek cia ltda, these may be billed to the client.
Each traveler must have individual liability insurance as well as individual comprehensive insurance to be protected from incidents or accidents that may occur before or during the trip.
In the absence of this document, the client must declare it to the tour Operator Tributreek cia ltda and thus release If the Client provides incorrect information and this results in additional costs to the tour Operator Tributreek cia ltda, these may be billed to the client. from any responsibility for accidents, injuries, death or physical problems that may occur during the tour, stay or trip in Ecuador.
In any case, we ask each client to provide us, prior to their arrival, the details of their personal insurance (contract number and phone number) and we recommend that you carry with you during the trip a copy of your contract, as you will be responsible for the declaration of claims to your insurance company (our guides and representatives will help in this process in the best way).
Each participant must comply with the requirements and formalities imposed by national, judicial and medical authorities at all times during the trip. In no case If the Client provides incorrect information and this results in additional costs to the tour Operator Tributreek cia ltda, these may be billed to the client., will replace the individual responsibility of the client, who will have to carry out all administrative and medical formalities in person before leaving on the trip (passport, visa, vaccination book, etc.) and during the duration of the trip, complying with the customs procedures of the country, which regulate the export of locally purchased items such as carpets, antiques, etc. included.
Failure to comply with these regulations, the inability of a client to present documents in good condition on the day of departure, any delay (even resulting from a case of force majeure in any type of transport service by sea, land or air that is not included within our services) implies the sole responsibility of the client and he/she will assume the expenses incurred.
Given the special nature of our trips, each participant will have to comply with the advice and instructions given by the guides or tour leaders in charge of the group and by the representatives of the tour Operator Tributreek cia ltda or any other institution, natural reserve or lodges visited during the tours. It will not be responsible in any way for incidents, accidents or personal injuries resulting from a reckless personal initiative of one or more participants.
– The client must be up to date with their travel authorization documents to enter Ecuador (Passport, Visa…).
Booking and cancellation of tour, stay and trip
Article 6 – Deposit and confirmation of the tour, stay or trip.
The reservation of a tour, stay or trekking, adventure, cultural or luxury trip in Ecuador, the Andes, the Galapagos, the Pacific coast or the Amazon will be made by If the Client provides incorrect information and this results in additional costs to the tour Operator Tributreek cia ltda, these may be billed to the client., only upon receipt of the deposit 35% of the total price of the stay, to be paid at the time of confirmation which is non-refundable.
If the confirmation of the purchase of the tour, stay or trip in Ecuador is made less than 70 days prior to the departure date of the stay, the total payment of the service must be paid at the time of booking.
Article 7 – Payment of the tour, stay or trip.
The remaining amount, 65% of the total value of the tour, stay or trip in Ecuador must be paid in U.S. dollars no later than 70 days prior to the start of the tour in Ecuador. Otherwise, the tour operator Tributreek Cia. Ltda will consider the trip, stay or tour in Ecuador or Galapagos as cancelled and, therefore, will apply the cancellation penalties stipulated in Article 7.
In case of payment by bank transfer to our account in Ecuador, the full amount of the bank charges will be assumed by the client.
1) Special conditions of sale.
In order to reduce the customer’s bank charges and at the customer’s express request, a single payment may be made on the first deposit. The customer must request this change as soon as possible. The changes made will be reflected in a new invoice that will be sent to the customer as soon as possible.
2) Exchange rate.
Price revision: our quotations are calculated in US dollars USD and our commitment relates to this amount, the value in (euro/other currencies) being indicative and calculated on the basis of the USD/EUR or other currency exchange rate on the day of the offer.
In the case of a direct payment by international transfer in USD/EUR, no revision of the trip price due to changes in the exchange rate will be made.
Ecuador or Galapagos as cancelled and, therefore, the cancellation penalties stipulated in Article 9 shall apply.
Article 8 – Modifications of the trip, stay or tour by the customer
Modifications to a trip may be accepted if they are possible. There will be no refund for a reduction of the travel time and for any service not used by the traveler for any reason.
The Operator Tributreek Cia. Ltda. may invoice the traveler for all additional expenses due to modifications required by the traveler.
The Operator Tributreek Cia. Ltda is not responsible for unused services of any modification during the trip or in the case of cancellation of cruises, suspension or modification of schedules and delays in domestic flights.
There will be no refunds for unused services, itinerary modification or loss of the trip if passengers arrive late at the airport and miss their flight.

Article 10 – Transferability of the reservation
The client may transfer his trip to Ecuador to a third party provided that the tour Operator Tributreek cia ltda, more than 25 days before the departure date. In this case, the new traveler will be jointly and severally liable for the obligations established in this contrac
Responsibility of the traveler
Article 11- Transportation to the meeting point at the beginning of the trip
The client is responsible for arranging his stay in Ecuador up to the meeting point that marks the beginning of the service provided by the Tour Operator.
Article 12 – Baggage.
During air transfers, the customer’s luggage is under the sole responsibility of the operating airline. Consequently, any loss, damage or theft of luggage must be dealt with directly between the client and the airline.
During the stay, tour or trip in Ecuador, the client is responsible for his/her own luggage.
Tour Operator Tributreek cia ltda is not responsible in case of damage to personal and valuable objects (camera, jewelry, cash, etc.) belonging to the traveler.
Likewise, the tour Operator Tributreek cia ltda is not responsible in case of forgetfulness or loss of articles or personal purchases made during the trip or cruise, for which the client would be responsible.
Jurisdiction
Article 13 – Jurisdiction and disputes.
– In case of litigation, the parties shall refer to the civil judge of the city of Quito and the procedure of the Ecuadorian civil code.
The registration to any of our trips implies the total adhesion to the Ecuadorian laws of tourism, to our general conditions of sale and/or to our particular conditions of sale, as well as to the respect of our instructions and recommendations present in the different notes and annexes in the travel documents.
Any litigation relating to the execution, interpretation and validity of this contract, without having been able to reach an amicable agreement, will be the exclusive competence of the Court of the Chamber of Commerce of Quito, which will apply Ecuadorian law.
The client expressly acknowledges having read and being aware of the information relating to the chosen trip thanks to the information provided by the tour Operator Tributreek Cia. Ltda.
Article 14 – Payment by bank transfer.
We receive payments into our Ecuadorian commercial bank account. Bank charges may vary depending on your bank’s policies.
